THE REALIZATION OF EXPORTS, IMPORTS AND THE FLOW OF FOREIGN EXCHANGE

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering :

that in order to better increase the economic development and to smoothen foreign trade, it is necessary to improve the arrangement on Realization of Exports, Imports and the Flow of Foreign Exchange.

THE GOVERNMENT REGULATION ON THE REALIZATION OF EXPORTS, IMPORTS AND THE FLOW OF FOREIGN EXCHANGE

CHAPTER I
FOREIGN EXCHANGE

Article 1

Anyone can freely obtain and use foreign exchange.

Article 2

(1) Foreign exchange that is resulted from export of goods and or services can be owned and used by the exporter in accordance with the need;

(2) If the foreign exchange results as contemplated in paragraph (1) of this article are sold partially or entirely to Bank Indonesia, then the sale shall be conducted through Foreign Exchange Bank (Bank Devisa) at Exchange Rate that is occurring in the Foreign Currency Exchange;

(3) If the importer buys a part or all of foreign exchanges for purpose of his import from the Foreign Exchange Bank (Bank Devisa), the Exchange Rate that is occurring in the Foreign Currency Exchange prevails.

CHAPTER II
PROCEDURES OF PAYMENT FOR EXPORT AND IMPORT

Article 3

(1) Payments for export and import shall be made in cash or in installments.

(2) The Minister of Trade and Cooperatives and the Governor of Bank Indonesia either collectively or severally in their scope of duty shall issue the implementing regulations on procedures of payment as contemplated in paragraph (1) of this article.

CHAPTER III
EXPORT LOAN, EXPORT LOAN GUARANTEE AND EXPORT INSURANCE

Article 4

(1) For development of export of non oil and natural gas, export loan, export loan guarantee and export insurance are provided as meant in paragraph (1) of his article;

(2) The Governor of Bank Indonesia shall issue the implementing regulations on export loan as meant paragraph (2) of this article;

(3) The export loan guarantee and export insurance facilities are provided by the government;

(4) The Minister of Finance, after hearing the opinion of the Minister of Trade and Cooperatives, shall stipulate the provision of export loan guarantee and export insurance as meant in paragraph (3) of this article.

CHAPTER IV
EXPORT CHARGES

Article 5

(1) To several types of goods, export charges referred to as Export Tax and or Additional Export Tax shall apply.

(2) The Minister of Finance after hearing the opinion of the Minister of Trade and Cooperatives and the relevant Minister shall determine the amount of Export Tax and or Additional Export Tax rates and stipulate classification of types of goods that are imposed to the Export Tax and or Additional Export Tax;

(3) Procedures of imposition of Export Tax and or Additional Export Tax shall be stipulated by the Minister of Finance.

CHAPTER V
IMPLEMENTATION OF EXPORT AND IMPORT

Article 6

(1) The Minister of Trade and Cooperatives shall determine Check Prices for certain exported goods periodically.

(2) The Minister of Finance after hearing the opinion of the Minister of Trade and Cooperatives and the relevant Minister shall determine the Check Prices for certain exported goods periodically as a basis for calculation of Import Duty.

(3) The Minister of Finance shall determine the Basic Value for Calculation of Import Duty (N.D.P.B.M) based on the current exchange rate.

Article 7

The Minister of Trade and Cooperatives determines certain goods that are prohibited to be exported and certain goods that are prohibited to be imported, which is adjusted to the deed and development of national economy and the states interest in general.

Article 8

The Minister of Trade and Cooperatives, the Minister of Finance and the Governor of Bank Indonesia, either collectively or severally in their scope of duty, shall improve the implementing regulations on Export and Import.

CHAPTER VI
CLOSE

Article 9

Upon the coming to force of this Government Regulation, all Regulations that contradict to this Government Regulation are declared null and void.

Article 10

This government regulation shall come to force as from the date of promulgation, for public cognizance, this Government Regulation shall be promulgated by publishing it in the Statute Book of the Republic of Indonesia.
